AND RESTORATION
IN TOWN ROADS
PART 1 - GENERAL
1.01 REQUIREMENT FOR STREET OPENING/ENTRANCE
PERMIT
- Any person desiring to make an excavation in any Town Way of
the Town of Brunswick (including any excavation outside the traveled
or paved way but within the public road bounds/easement) shall
first obtain a Street Opening Permit from the Public Works Director.
- Any person desiring to construct or establish an entrance to
any Town Way in the Town of Brunswick (including the widening
of any existing entrance) shall first obtain an Entrance Permit
from the Public Works Director.
- All such work within the Town Way is governed by Title 23 M.R.S.A.
§ 3351 to 3381 and Chapter 14, Article IV of the Municipal
Code of Ordinances for the Town of Brunswick and these rules and
regulations.
1.02 DEFINITIONS
- "Applicant" shall mean the authorized person representing
the property owner being served by the work or the contractor
who signed the Street Opening Permit. The applicant shall be considered
the "Permittee" under this specification.
- "Contractor" shall mean the person(s) or firm performing
the work within the Town Way.
- "Engineer" shall mean the Town Engineer/Public Works
Director for the Town of Brunswick or his duly authorized representative.
- "Entrance Permit" shall mean the permit as issued
by the Public Works Department for new or widened driveways connecting
to a Town road.
- "Owner" shall mean the Town of Brunswick.
- "Property Owner" shall mean the property owner being
served by the work performed as authorized under the Street Opening
Permit. The Property Owner shall be responsible for all actions
of the Applicant and Contractor and shall be considered a "Permittee"
under this specification.
- "Street Opening Permit" shall mean the permit as
issued by the Public Works Department for any excavations in the
Town Way.
- "Town Way" shall mean an area or strip of land designated
and held by the Town of Brunswick for the passage and use of the
general public by motor vehicle. The Town Way shall include all
land within the full width of the road easement (right-of-way)
and shall include State owned roads maintained by the Town of
Brunswick
- "Work" shall mean any construction activity taking
place in whole or in part within the Town Way.
1.03 GENERAL INFORMATION
- Restoration of town property shall be the responsibility of
the Permittee and all such restoration work shall be performed
in accordance with these specifications.

All curb and sidewalk construction/restoration shall comply
with the American National Standard, ANSI A117.1-1986, for providing
accessibility and usability for physically handicapped people.
- The term "Standard Specification" as referenced shall
mean the Standard Specifications, Highways and Bridges issued
by the State of Maine, Department of Transportation (MDOT), Revision
of April 1995 including all addenda thereto.
- The Permittee is responsible for obtaining any permits or approvals
as may be necessary for this work from any agency or Town department
also having jurisdiction over the work, including, but not limited
to the following:
- Clearance from Underground Facility Operators (per Dig-Safe
Law)
- Brunswick Sewer District (729-0148)
- Brunswick-Topsham Water District (729-9956)
- Town of Brunswick Codes Enforcement Office (725-6651).

Issuance of a Street Opening Permit does not constitute an
approval by any other agency or Town department.
1.06 INSURANCE
- The Permittee or Contractor shall provide and maintain liability
insurance coverage for premises, operations (Bodily Injury/Property
Damage $300,000 Combined Single Limit / $600,000 Aggregate) before
the start of any work within the Town Way.

Upon demand a copy of the Certificate of Insurance on the Standard
Insurance Comprehensive Form shall be provided to the Public Works
Department.
1.07 EXISTING UTILITIES
- Before commencing any excavation work the Permittee shall notify
all Underground Facilities Operators and DIG SAFE in accordance
with Maine State Law. For information purposes only, the following

Where the Permittee is required or has removed for the convenience
of his work any traffic sign, sign or similar improvement, he
shall restore same to its original place in as good a condition
as was originally found.

The Permittee shall be responsible for protecting, within the
work zone, any existing and right-of-way or survey monuments (i.e.,
iron pipes, granite markers, etc.) during construction. If it
is apparent the construction work may or will disturb monumentation,
the Permittee shall contact a Professional Land Surveyor so that
monumentation can be located and offset prior to excavation.

If the excavation/construction work disturbs or removes any
existing property or right-of-way monumentation or survey marker,
the Permittee shall, at his or her expense, have the monument
re-set by a Professional Land Surveyor.

All traffic regulatory signs that must be removed to progress
the work shall be temporarily relocated and shall remain in service
as directed by the Town Engineer.
1.08 MAINTENANCE OF TRAFFIC
- Provide all facilities and traffic controls needed per the
Manual of Uniform Traffic Control Devices (MUTCD), Part VI, to
allow safe conduct of the Work while maintaining public use of
the site, including, but not necessarily limited to:
- Warning signs, barricades, delineators, lights, cones, etc.;
- Flaggers with appropriate signs and ability to direct traffic
through the work site.

Traffic control shall be the sole responsibility of the Permittee.
- For streets listed below a Traffic Control Plan shall be submitted
to the Engineer for prior approval if the work zone will occupy
or block any of the travel lanes on any of the streets: The Permittee
shall submit one reproducible copy of the plan(s). The plan shall
identify the means whereby partial or full disruption of traffic
will be safely cared for. The Permittee shall prepare the traffic
control plan in conformance with the requirements of the US Department
of Transportation, "Manual of Uniform Traffic Control Devices,"
(MUTCD), Part VI, "Standards & Guides for Traffic Controls
for Street and Highway Construction, Maintenance, Utility, and
Incident Management Operations," 1988 Edition, Revision 3,
Sept. 3, 1993, and the Maine Department of Transportation, Traffic
Control Handbook, May 1995. Include on the plan, but do not necessarily
limit control devices to:
- Location of warning signs (indicate wording or symbols to be
used);
- Location of delineators, barricades, cones or similar devices;
- Location of flagging stations.

(Other streets may require a Traffic Control Plan to be submitted
and approved in advance as may be determined by the Engineer or
Chief of Police.)
- No street is to be closed completely to thru traffic unless
a traffic control plan has been submitted to and approved in advance
by the Engineer and the appropriate signs are in place. Work on
state numbered routes will require a complete Detour network if
such streets are closed to thru traffic.
- The Town of Brunswick reserves the right to restrict the duration
and scheduled closing of any street. The Permittee shall take
all steps to minimize the time a street is to be closed to thru
traffic. For approved closures the following shall be required:
- Restore all streets to two way traffic during all non-work
times (the street shall be left in a safe condition to allow such
traffic).
- No open excavations are to be left in the traveled way over
night unless specifically approved.
- Coordinate all blockage of drives with the affected property
owners.
- Implementation of Traffic Control:
- All work zone signs shall be reflectorized with black lettering
on an orange background, or as specified in the MUTCD. A sufficient
number and type of signs and traffic control devices shall be
provided in accordance with the MUTCD.
- The Permittee shall provide flagging stations as detailed by
the traffic control plan or if deemed necessary by the Engineer
in order to maintain a smooth and safe flow of traffic. Flaggers
shall be provided with a hard hat, safety vest, paddle sign and
shall direct and control traffic in a safe and MUTCD approved
manner.
- Inspect site at least twice daily to verify all controls are
in place and the site is in proper and safe condition throughout
the progress of the work.
- The Permittee is responsible for contacting in advance the
Police (725-5521) and Fire Department (725-5541) to constantly
appraise them of traffic detours and road blockages.
- The Permittee shall provide and maintain at all times during
the work an adequate ingress and egress for the residents and
any businesses in or adjacent to the work site.
- Emergency vehicle access shall be allowed within the work site
at all times.
- The Permittee shall provide emergency service at nights and
on the weekends should the work site need attention due to weather
conditions or similar problems. An on-call number shall be given
to the Engineer and Police Department.
- All traffic regulatory signs that must be removed while work
progresses shall be temporarily relocated and shall remain in
service as directed by the Engineer.
1.09 CLEANING EXISTING PAVEMENT AND
DUST CONTROL
- The Permittee shall on a regular basis, or after notice by
the Engineer, remove and sweep clean any dirt, mud, silt, or any
other debris that accumulates on the pavement in the area of the
project. Such action by the Permittee shall be done to the satisfaction
of the Engineer and whenever deemed necessary by the Engineer.

The Permittee shall conduct his operations and maintain the
area of his activities, including sweeping and sprinkling of streets
and the building site, as necessary, so as to minimize the creation
and suppression of dust. The use of calcium chloride for dust
control is prohibited unless specifically allowed in writing by
the Engineer. The Permittee shall control dust through periodic
sweeping and wetting of the project area or through the use of
straw mulch in some cases.
1.10 MAINTAINING EXISTING SERVICES
- The Permittee shall maintain services of any and all private
or public utilities during the course of the work as directed
by the Engineer. Required interruptions shall be scheduled in
advance with the Town Engineer and the work performed continuously
so as to minimize the duration of interruption.

No gutters or ditches shall be obstructed so as to interfere
with surface drainage, except as permitted by the Engineer. Take
temporary measures for runoff control to prevent sediment from
discharging into the storm drainage system. Such measures shall
conform to the "Maine Erosion and Sediment Control Handbook
for Construction: Best Management Practices" as prepared
by the Cumberland Country SWCD, dated March 1991. Such measures
may include:
- straw bale dike
- silt fencing
- temporary swales
- sediment traps
Obtain approval of the Town Engineer of proposed method(s) prior
to commencing any excavation work.
PART 2 - PRODUCTS
2.01 BASE COURSES
- General:
Materials shall be natural soil or rock of such character that
it can be placed and compacted in a reasonable length of time.
All materials shall be free of organic or other weak or compressible
materials, rubbish, trash, vegetation, building rubble or frozen
matter.
- Grade D Gravel:
The material shall consist of clean, hard, durable particles,
free from lumps of clay, organics, and all deleterious substances
and shall comply with the following gradation:

- Grade A Gravel:
The material shall be a crushed gravel consisting of clean, hard,
durable particles, free from lumps of clay, organics, and all
deleterious substances and shall comply with the following gradation:

2.02 BITUMINOUS CONCRETE
- The bituminous concrete plant mixture shall conform to the
Standard Specifications, Section 401.02. Aggregate for the various
applications shall conform to the following:
- Binder Course: Aggregate material shall conform to the Standard
Specifications, Item 703.09, Grade B.
- Top Course: Aggregate material shall conform to the Standard
Specifications, Item 703.09, Grade C.

Top Course for Sidewalks. Aggregate material shall conform
to the Standard Specifications, Item 703.09, Grade D.

Bituminous Curb. Curb material shall conform to the Standard
Specifications, Item 712.36 and be fiberglass reinforced (BoniFiber
B or equal).
PART 3 - EXECUTION
3.01 SAW-CUTTING EXISTING PAVEMENT
- The roadway pavement shall be cut to its full depth before
excavation commences. The Permittee shall use a rotary saw or
a steel cutting wheel providing the pavement is cut for the full
depth and a neat straight cut is produced. If the cutting method
used does not produce satisfactory results, the Permittee shall
take alternative action as directed by the Engineer. If the construction
operations damage the cut line, the Permittee shall cut out the
damaged area/edge by square cutting the area to remove the damaged
section as approved by the Engineer.
- Backfill excavations in lifts to the base layer. Mechanically
compact fill in layers as specified below. Excavated material,
excluding boulders/rocks greater than 8 inches, pavement and organic
material, may be re-used as general backfill providing it does
not contain an excessive amount of clay, which prevents good compaction.

Backfill for the base courses is to be with 12" of Grade
D gravel followed by a 3" layer of Grade A gravel for areas
to be repaved.
- All material shall be mechanically compacted in layers not
more that 12 inches in thickness. Compaction and methods shall
be as required by the Standard Specifications (Section 206-03).

Add water during the backfilling process to maintain proper
moisture content of the material to obtain proper compaction.
- After placing and compacting the two gravel base courses as
described above, place (except as noted in paragraph B. below)
a 2" dense binder course and then tack coat all pavement
edges and place a 1" top course layer. Each layer shall be
raked and checked with a straight edge and then compacted with
a steel wheeled roller. For areas inaccessible to the roller,
a vibrating plate tamper will be used.

For the following streets the restoration shall consist of
a total pavement restoration of 4 inches (consisting of one course
of 2½" dense binder pavement followed by a 1½"
top course layer):

For roadway areas other than trench cuts, an automatic paver
with vibrating screed shall be used to place the pavement. All
such paving operations shall be in accordance with the Standard
Specifications.

Where saw-cut lines are damaged during excavation or backfilling,
they shall be re-done by and at the Permittee's expense to remove
the damaged area prior to restoration of the pavement.
- Any sidewalk requiring repair or restoration shall be replaced
to match the existing type sidewalk. These specifications cover
asphalt sidewalk only. For concrete or brick paver sidewalk contact
the Engineer for specified requirements.

All sidewalk repair work shall comply with applicable requirements
for handicap accessibility in accordance with the Americans with
Disabilities Act (ADA) and ANSI 117.1-1986.
-
Any damaged asphalt sidewalk area will be restored with at
least a 6" Grade A gravel top course and a 2" mat of
hot mix paving (i.e., 1" MDOT Grade C base course with Grade
D 1" top course) placed in two lifts.
-
Sidewalks are to be increased to a 3" depth across any
driveways other than those drives serving one or two family residences.
-
The longitudinal sidewalk slope is not to exceed 1 vertical
to 20 horizontal (except it may be 1 vertical to 12 horizontal
for transitions at intersections).
-
The sidewalk cross-slope should generally be at 1 vertical
to 48 horizontal (1/4" per foot) and at driveways may not
exceed 1 vertical per 24 horizontal (½" per foot). The
sidewalk cross-slope should pitch towards the street.
(These specifications cover asphalt curb only. For granite or
concrete curb all work shall conform to the Standard Specifications.)
- Restore the asphalt curb to match the adjoining curb size and
shape.

Provide a 6" curb reveal for all replacement curb.
-
The curb shall have a foundation equal to the road base with
a 12" wide 2" thick asphalt base to fully support the
asphalt curb. Prior to placing the curb, the foundation course
shall be thoroughly cleaned of all foreign and objectionable material.
String or chalk lines shall be positioned on the prepared base
to provide guide lines. The foundation shall be uniformly painted
with tack coat as specified under Standard Specifications, Section
410 - Bituminous Surface Treatment.

The curb shall be placed by an approved power operated extruding
type machine using the shape mold called for. A tight bond shall
be obtained between the base and the curb. The Engineer may permit
the placing of curbing by other than the mechanical curb placing
machines when short sections or sections with short radii are
required. The resulting curbing shall conform in all respects
to the curbing produced by the machine.

Curb may be accepted or rejected on the basis of appearance
in regard to texture, alignment or both. All damaged curb shall
be removed and replaced at the Permittee's expense.
- The Engineer shall be contacted by the Permittee to inspect
all work. Inspection notification, at least 24 hours in advance,
is required for the following phases of the work:
- Start of Work.

Prior to start of any backfilling operations.
-
Prior to start of any paving operations.
- Where the Engineer or authorized representative requires corrective
work upon inspection, the Permittee shall comply with all such
direction prior to proceeding further on the project.

The determination as to acceptability of the work shall be
at the sole discretion of the Engineer.
- The Permittee is responsible for and agrees to guarantee all
work is free from defects in workmanship or material for a period
of two (2) years from the completion of the work. If any settlement,
cracking, pavement deterioration or similar problem occurs the
Permittee shall promptly repair such defect at no expense to the
Town of Brunswick.

If the Permittee fails to timely repair a defect, the Town
of Brunswick reserves the right to cause the repairs to be made
with all costs incurred to be at the expense of the Permittee.
